These Terms & Conditions (“Terms”) govern your access to and use of Tokma’s websites, mobile applications (including Tokma App and Tokma Provider App), and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
If you do not agree, do not use the Services.
1) Who We Are
“Tokma,” “we,” “us,” or “our” refers to Tokma and its operators.

2) Eligibility and Accounts
- You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services.
- You agree to provide accurate account information and keep it updated.
- You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
3) Services Overview
Tokma provides a platform that helps users discover and book service packages and helps providers manage bookings. Tokma may act as a marketplace/technology platform and does not itself perform the services unless explicitly stated.
4) Bookings, Provider Communication, and Changes
A. Booking confirmations
When you book a package, Tokma may send confirmations and updates via in-app notifications, email, and/or SMS.
B. Provider relationship
Providers are independent and responsible for delivering services. Users and providers are responsible for their communications and agreements, subject to these Terms.
C. Cancellations and rescheduling
Cancellation/rescheduling options may vary by package/provider and may be subject to time windows or fees shown in the app at the time of booking.
D. No-shows
If a user fails to show up or is unavailable, or if a provider fails to deliver, Tokma may apply policies shown in the app (if any) and may investigate repeated misuse.
5) Payments, Fees, and Refunds
- If Tokma supports payments, you authorize Tokma (and/or its payment partners) to process payments for bookings and applicable fees.
- Taxes and fees (if any) may be added and displayed at checkout.
- Refunds (if offered) follow the refund/cancellation rules displayed in the app or communicated by support.
6) SMS/Text Messaging Terms
By providing your phone number and opting in, you consent to receive transactional text messages from Tokma related to your account and bookings (e.g., OTP verification, account welcome messages, booking confirmations, booking updates, cancellations, and important service notifications).
- Message frequency varies based on your activity.
- Message & data rates may apply depending on your carrier plan.
- To opt out at any time, reply STOP.
- For help, reply HELP or contact hello@tokmadigital.com.
- Carriers are not liable for delayed or undelivered messages.
7) Acceptable Use
You agree not to:
- Use the Services for illegal, harmful, abusive, or fraudulent purposes
- Misrepresent your identity or provide false information
- Harass, threaten, or discriminate against others
- Interfere with the security or operation of the Services
- Attempt to access accounts, data, or systems you are not authorized to access
Tokma may suspend or terminate access for violations.
8) User Content and Reviews
If you submit content (messages, reviews, images, etc.), you grant Tokma a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content for operating and improving the Services. You are responsible for ensuring you have the rights to post it and that it does not violate laws or third-party rights.

10) Third-Party Services and Links
The Services may include links or integrations to third-party services. Tokma is not responsible for third-party content, policies, or practices.
11) Disclaimers
- The Services are provided “as is” and “as available.”
- Tokma does not guarantee uninterrupted or error-free operation.
- Tokma does not guarantee provider availability, service outcomes, or that services will meet your expectations.
12) Limitation of Liability
To the maximum extent permitted by law, Tokma will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising out of your use of the Services.
Tokma’s total liability for any claim will be limited to the amount you paid to Tokma (if any) in the 3 months before the event giving rise to the claim, unless the law requires otherwise.
13) Indemnification
You agree to indemnify and hold Tokma harmless from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another.
14) Suspension and Termination
Tokma may suspend or terminate your access if:
- You violate these Terms
- Your use creates risk or legal exposure
- Required by law or to protect safety/security
You may stop using the Services at any time.
15) Changes to the Services or Terms
We may update the Services or these Terms from time to time. We will post updates and revise the “Last Updated” date. Continued use after changes means you accept the updated Terms.
16) Governing Law and Venue
These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Omaha, unless applicable law requires otherwise.
